Introduction

These Terms of Service (the "Terms") govern your use of Peak Checkout (the "Service"), provided by George Ecommerce, established at Kerketuinenweg 2 Unit 8602, 2544 CW 's-Gravenhage, Netherlands and registered with the Dutch Chamber of Commerce under number 78636477 ("we", "us").

You agree to these Terms when you create an account or use the Service. If you do not agree, do not use the Service. These Terms are written for business users: you enter into this agreement on behalf of your company.

1. What the Service does

Peak Checkout is software that replaces the native checkout of your Shopify store with your own hosted checkout page on your own subdomain. Payment runs through your own Whop account, and the paid order is written back into your Shopify Admin automatically.

We are a software provider. We are not a payment processor, a bank or the seller of your products, and we never hold your customers’ funds. The money for an order lands in the balance of your own Whop account. Whop’s rates and payout terms are agreed between you and Whop, not with us.

Your relationships with Shopify and with Whop remain your own. You are responsible for complying with their terms. We point out explicitly that Shopify’s terms restrict the use of a checkout other than Shopify’s own; you assess that risk yourself, and we inform you about it before you go live.

2. Accounts

You provide accurate information and keep your login credentials secure. Everything that happens under your account is your responsibility. You are at least 18 years old and authorised to bind the business you represent.

You decide who in your organisation has access to the Peak admin, and you remove that access as soon as someone no longer needs it. Tell us immediately if you suspect that someone has unauthorised access.

3. Fees and billing

You pay for the Service as agreed in your order or quotation. That document sets the amount, the payment term and the duration. These Terms state no prices; the agreement in your quotation prevails.

All amounts are exclusive of VAT unless stated otherwise. Whop’s transaction fees and Shopify’s fees are separate: you pay those directly to Whop and Shopify at your own rate.

We may change our prices with reasonable notice. If you do not accept an increase, you may terminate the agreement as of the date the new price takes effect.

4. Your responsibilities as the merchant

You are and remain the seller. That means you are responsible for:

You are the merchant of record and therefore responsible for VAT yourself: registering, charging, filing and remitting it in every country where you sell. Our checkout shows VAT-inclusive prices and carries your Shopify store’s tax settings into the order, but that is a tool, not tax advice.

• your products, prices, stock and delivery times;
• your own store policies — refunds, shipping, privacy and terms — shown at the checkout;
• fulfilling orders and handling customer support;
• refunds to your customers, chargebacks and disputes with your customers;
• complying with the law, with the terms of Shopify and Whop, and with card-network rules;
• VAT and all other taxes on your sales.

5. Acceptable use

You may not use the Service for fraud, money laundering, prohibited or illegal goods, or anything that breaches the rules of Shopify, Whop or the payment networks. You do not circumvent, overload or reverse-engineer the Service, and you do not give access to third parties outside your organisation.

We may suspend or terminate an account if we reasonably believe these Terms are being breached, or that there is a risk to us, to our providers or to your customers. Where we can, we warn you first.

6. Availability and warranties

We work to keep the Service reliable, but we provide it "as is" and "as available". We do not guarantee uninterrupted or error-free operation, and to the extent Dutch law allows we exclude all warranties.

We announce maintenance in advance where possible. Outages at Shopify, Whop or other parties the Service depends on are outside our control.

This exclusion does not apply to anything that mandatory Dutch law does not allow to be excluded.

7. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential loss, lost profit, lost revenue, loss of data or reputational damage.

Our total liability for all claims together is limited to the amount you paid us for the Service in the three months before the event.

These limitations do not apply in case of intent or wilful recklessness on our part, nor where mandatory Dutch law prohibits a limitation.

8. Termination, suspension and the kill switch

You may terminate the agreement on the notice period stated in your order or quotation. We may suspend or terminate the Service for a material breach of these Terms, or for non-payment after a reminder.

The admin contains a kill switch. It turns the Peak checkout off in one action; your store then falls back to Shopify’s native checkout immediately, with no theme edit. We may use that switch ourselves where it is needed to stop an outage, a security incident or a payment problem. We tell you as soon as we can when we do.

On termination your right to use the Service ends. Provisions that by their nature survive — amounts owed, liability, confidentiality — continue to apply. Your order records in Shopify and your money at Whop remain yours; they sit outside our Service.

9. Changes

We may amend these Terms. Material changes are published on this page with a new date and are announced to you by email. If you keep using the Service after the effective date, the new Terms apply.

10. Governing law and contact

These Terms are governed by the laws of the Netherlands. Disputes are submitted to the competent court of the Rechtbank Den Haag (District Court of The Hague), the district where George Ecommerce has its seat, unless mandatory law designates another court.

Introduction

This policy explains how George Ecommerce handles personal data: on this website, in the Peak admin, and in the checkout we run for stores.

We have two different roles. Which role we are in determines who you should address for your rights.

1. Our role: processor and controller

For the data entered in a store’s checkout we are the processor. The store (our client) is the controller: it decides why and how the data is used, and we sign a data processing agreement with it. If you are a shopper, read that store’s own privacy notice and address your request there.

For this marketing site, for our own administration and for store owners’ admin accounts, we are the controller ourselves.

2. What data we process

In the checkout, on behalf of the store:

For our own service we also process account data of store users (name, email address, login and session data, actions in the admin) and a store’s configuration (domain, branding, shipping rates, discount codes, integrations).

We never store or see card details: the payment form belongs to Whop and runs in its own frame inside the checkout page.

• contact data: email address, phone number, name, and whether marketing consent was given;
• address data: shipping and billing address;
• order data: products, quantities, amounts, shipping method, discount code, VAT and total;
• funnel events: which checkout step was reached (started, contact, shipping, payment started, paid, abandoned) and when;
• technical data for security: IP address, browser type and request identifiers in our logs, used against abuse and as evidence in payment disputes.

3. Who we share data with

We do not sell personal data. We share it only with parties needed to deliver the Service, or with destinations the store has configured itself:

When a store configures an advertising or email integration, we forward events to it server-side. Identifiers such as email address and phone number go to the advertising platforms as a hash only, because those platforms require it. Klaviyo is the store’s own email system and therefore receives contact data in readable form. The store chooses these destinations and is responsible for them; what happens afterwards falls under that party’s own privacy policy.

• Whop — the payment, the payout and refunds;
• Shopify — the merchant’s store, where the paid order is created;
• the tracking destinations configured by the store: Meta, Google Analytics 4 / Google Ads, TikTok, Pinterest and Klaviyo;
• our own providers for hosting, database and email, who process only on our instructions.

4. How long we keep data

We keep data as configured per store, and as long as needed for the order, our records and statutory retention periods. After that we anonymise or delete it.

Contact and address data of checkouts that never led to a payment are erased automatically once the retention window passes; for paid orders only what is needed as a financial record is kept. If a store asks us to delete a customer’s data, we carry that out straight away.

5. Your rights (GDPR / AVG)

You have the right to access, rectification, erasure, restriction and portability of your data, and you may object to certain processing. Where we act as processor, your request goes through the store you bought from; we help that store carry it out.

Email info@peakcheckout.com with a request or a question. You may also lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).

6. Cookies on this website

This marketing site uses functional cookies only. There are no advertising or analytics cookies on it, and we do not track you here.

The only cookie we set is the language cookie, which remembers whether you want the site in Dutch or English. A store’s checkout additionally uses only what is technically needed to complete your order.

1. What this policy covers

This policy covers what you pay us for the Peak Checkout software. It does not cover refunds to your store’s customers: your own refund policy governs those.

2. Cancelling your subscription

You cancel on the notice period stated in your order or quotation, by email to info@peakcheckout.com. The Service keeps running until the end of the current period and is not renewed after that.

If you want to return to Shopify’s native checkout sooner, use the kill switch in the admin. It takes effect immediately and needs no theme edit. Cancelling the agreement is a separate, written step.

3. Refunds of software fees

Fees for a period already delivered are in principle not refunded, including for part of a month. What applies to prepayment or to early termination is set out in your order or quotation.

Think you were charged in error? Tell us within 30 days of the invoice date at info@peakcheckout.com and we will review it in good faith.

4. Refunds to your customers

A refund to a customer is a matter between that customer and your store. We are not a party to it and we do not hold the money: it sits in your own Whop account.

You issue the refund in Whop, in full or in part. Peak Checkout then mirrors that refund onto the matching order in your Shopify Admin, so your records stay correct. Your own refund policy decides whether and when a customer is entitled to a refund.

5. Transaction fees and disputes

Transaction fees are charged by Whop at your own rate and are separate from what you pay us. Whether those fees are returned with a refund is decided by Whop.

You handle chargebacks and payment disputes yourself, through Whop. On request we provide the checkout data you need as evidence.
